An investment agreement was signed on 28 June 2017 under the framework of the Mainland and Hong Kong Closer Economic Partnership Arrangement between the HKSAR Government and the Ministry of Commerce (CEPA Investment Agreement). The CEPA Investment Agreement provides a Mediation Mechanism for Investment Disputes for settlement of an investment dispute arising from an alleged breach of the substantive obligations of the Agreement by one side causing loss to an investor of the other side.  The Mainland and Hong Kong mutually agreed on the lists of mediation institutions and mediators in accordance with the Mediation Mechanism.  Currently, there are two designated Hong Kong mediation institutions, namely, Hong Kong International Arbitration Centre - Hong Kong Mediation Council and Mainland - Hong Kong Joint Mediation Center, and 19 designated Hong Kong mediators. 

With the CEPA Investment Agreement’s Mediation Mechanism for Investment Disputes in place, we have been working towards developing Hong Kong into a capacity building hub for international investment law and investment dispute resolution with a view to building up a team of investment law and investment dispute mediators in Asia.  DoJ has been organising a training course comprising modules in mediation skills in relation to investment law and investment dispute since 2018 in Hong Kong.  The latest edition of the training course was held on 31 May - 1 June and 20 November 2024, attracting around 140 participants from over 20 jurisdictions to attend the training.
